eOne Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using the eOne app (the "App"), you agree to be bound by these terms and conditions ("Terms"). If you do not agree to these Terms, do not use the App. The App is operated by E ONE SAS (eOne) ("Company").

2. Use of the App

2.1. Eligibility: You must be at least 18 years old and have a valid driver's license to use the App.

2.2. Account Creation: You may need to create an account to use the App. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account.

2.3. Charging Locations: The App provides information on EV charging locations. The Company does not own or operate these charging stations and is not responsible for their availability, functionality, or safety.

2.4. Payment: You can use the App to pay for charging sessions using a credit card. You authorize the Company to charge your credit card for the amount of the charging session.

3. Fees and Charges

3.1. Charging Fees: Charging fees vary depending on the charging station and the duration of the charging session. The App will display the applicable fees before you start charging.

3.2. Other Fees: The Company may charge additional fees for certain services, such as reservation fees or idle fees. These fees will be displayed in the App before you use the service.

4. Intellectual Property

4.1. App Ownership: The App and all intellectual property rights in the App are owned by the Company. You may not use the App for any commercial purpose without the Company's prior written consent.

4.2. User Content: You retain ownership of any content you submit through the App, but you grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

5. Disclaimer of Warranties

5.1. As-Is Basis: The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. The Company disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.2. Charging Station Information: The Company does not guarantee the accuracy, completeness, or reliability of the information provided in the App regarding EV charging locations.

6. Limitation of Liability

6.1. Indirect Damages: The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the App.

6.2. Maximum Liability: The Company's total liability for any damages arising out of or in connection with the use of the App shall not exceed the amount paid by you to the Company for the charging session that gave rise to the claim.

7. Indemnification

You agree to indemnify and hold the Company harmless from any claims, damages, liabilities, and expenses arising out of your use of the App or your violation of these Terms.

8. Termination

The Company may terminate your access to the App at any time for any reason.

9. Changes to Terms

The Company may update these Terms from time to time. You will be notified of any changes and your continued use of the App after the changes have been made constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Uruguay.
