Terms and Conditions for the Asgard EV Mobile App and EV Charging Payment Services

Please carefully read these terms and conditions (“Terms and Conditions”), the Services Personal Information Collection Statement (“PICS”; see clause 7) and my Privacy Policy (“Privacy Policy”) before using the Asgard EV mobile application (“Asgard EV App”) and Asgard EV Charging Payment Services (“Services”). The Asgard EV App and Services are provided by Asgard Group Limited (referred to as I, me, my, mine and myself) at EV Charging Facilities. By using the Services, you are deemed to have read, understood and agreed to be bound by these Terms and Conditions, the PICS and the Privacy Policy. If you do not agree, you may not use the Asgard EV App or Services.

1. Definitions and Interpretations

1.1 Application: All versions of the software or program used to provide the Services in any form, including websites, mobile apps, and systems.
1.2 Derivative Works: Any work created from or based on existing works, such as modifications, improvements, or translations.
1.3 EV Charging Facilities: Locations listed by me that use the Asgard EV app and Services for payment.
1.4 Asgard EV Charging Payment Services or Services: A feature in the Asgard EV App for reporting EV charging fees and collecting payments.
1.5 Required Information: Information needed to register, including name, email, phone number, license plate, app ID, and credit card details.
1.6 Transaction: Charges made for EV charging services or penalties.
1.7 User: A registered user of the Asgard EV App and Services.
1.8 Interpretative rules regarding language and clause references are included.

2. Registration and Activation

2.1 Services are available via the Asgard EV App and payment kiosks.
2.2 Users must submit Required Information and agree to the Terms.
2.3 By registering or using a kiosk, you confirm ownership and authority over the vehicle and credit card used, and that your information is accurate.
2.4 You consent to the use and sharing of your Required Information for the Services.
2.5 Each Charging Facility may have its own terms; I am not responsible for them.
2.6 Accounts may be suspended after 180 days of inactivity.
2.7 Only one license plate and one credit card can be registered per user.
2.8 Users are responsible for enabling push notifications to receive messages from me.
2.9 You may cancel the Services anytime if there are no outstanding payments.
2.10 Services may be suspended if payments are overdue.
2.11 Services are terminated upon credit card expiration or cancellation.
2.12 I reserve the right to suspend or cancel Services at any time.

3. Payment for Transactions

3.1 All payments are non-refundable and final.
3.2 Charging rules are determined by each EV Charging Facility. For charges under 1 kWh, a full kWh fee applies.
3.3 I am not liable for fee miscalculations due to delayed updates from facilities.
3.4 Contact the facility for parking or service inquiries.
3.5 Payment confirmations are sent via app, SMS, or email.

  • (a) For full charges, payment is processed upon completion.
  • (b) For partial charges, payment is processed when selected.
  • (c) Penalties may apply for overstaying.

3.6 Users must check charges before using Services.
3.7 Any amount due is immediately payable.
3.8 Reminders may be sent via app, SMS, or email.
3.9 After 15 days of non-payment, Services may be terminated.
3.10 For disputes, contact customer service.
3.11 Terminated accounts cannot be re-used for registration.

4. Your Responsibilities

4.1 Keep your information up to date and cancel your account if you no longer own the registered vehicle.
4.2 You must indemnify me for any misuse of the App or Services.

5. Rules and Restrictions for the Services

5.1 You must comply with EV Charging Facility rules.
5.2 Only one vehicle and one license plate can be registered.
5.3 Only one credit card may be used.
5.4 Video surveillance may be used for security and verification purposes. Notices will be posted, and surveillance is subject to privacy laws.

6. Disclaimer of Liability

6.1 Operators of EV Charging Facilities are solely responsible for their services.
6.2 You remain liable for any unauthorized use of your account.
6.3 I am not liable for any loss arising from use of the App, kiosks, or Services.

7. Personal Information Collection Statement (PICS)

7.1 You agree to provide Required Information.
7.2 Information may be used for:

  • Providing and maintaining Services
  • Billing and transactions
  • Legal compliance and collection
  • Communications and promotions

7.3 Required Information may be shared with:

  • EV Charging Facilities
  • Credit card providers (e.g., Nuvei Technologies Corp., Adyen Hong Kong Ltd.)
  • Agents and contractors

7.4 Your data may be transferred within or outside Hong Kong.
7.5 You have the right to access and correct your information.
7.6 A fee may apply for data access requests.

Governing Law and Jurisdiction

These Terms are governed by Hong Kong law. Any disputes will be resolved by the courts of Hong Kong.

Contracts (Rights of Third Parties) Ordinance

Third parties have no rights under these Terms.

English Version Prevails

If there is a conflict between the English and any Chinese translation, the English version will prevail.
